OVERVIEW

 

This website is operated by Timefold (“we”, “us”, “our”).

 

These Terms of Service (“Terms”) govern your use of timefold.com.au and purchases, orders and services provided through our website.

 

By accessing our website, uploading content or placing an order, you agree to these Terms.

 

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law (ACL).

 

 

1. USE OF OUR WEBSITE

 

By using our website, you agree that:

 

- you have legal capacity to enter into the transaction, or use the website with the involvement of a parent or legal guardian where required;

- you will not use our website or services for an unlawful or fraudulent purpose;

- you will not upload content that infringes copyright, intellectual property, privacy or other third-party rights; and

- you will not interfere with the security or operation of our website.

 

We may refuse or restrict service where reasonably necessary, including in cases of suspected fraud, misuse or unlawful activity.

 

 

2. CUSTOM-MADE PRODUCTS

 

Timefold specialises in custom printing and picture framing.

 

Products may be individually produced according to customer selections including:

 

- photograph or artwork;

- print size;

- orientation;

- frame colour;

- frame profile or style;

- mat board options; and

- other available customisation options.

 

You are responsible for reviewing your selections and order information before completing checkout.

 

Because products are made specifically to customer specifications, we do not generally offer cancellations, returns or refunds merely for change of mind once production has commenced.

 

This does not affect rights under the Australian Consumer Law.

 

 

3. NATURAL AND HANDCRAFTED VARIATIONS

 

Our framed products are individually assembled and may use natural materials such as timber.

 

Minor variations may occur in wood grain, texture, natural markings, colour tone, dimensions or finishing details.

 

Reasonable variations inherent in natural materials or handcrafted production are not necessarily defects.

 

This does not affect your rights where a product fails to meet an applicable consumer guarantee.

 

 

4. UPLOADED IMAGES AND CONTENT

 

Our website allows customers to upload photographs, artwork and other image files for printing and framing.

 

By uploading content, you confirm that:

 

- you own the content or have the necessary rights and permissions to reproduce it;

- reproduction does not infringe copyright, trademark, privacy or other third-party rights; and

- the content does not violate applicable law.

 

You grant Timefold a limited permission to store, process, reproduce and print the uploaded content as necessary to provide our services and fulfil your order.

 

You retain ownership of your uploaded content.

 

Timefold will not use customer-uploaded images for advertising or promotional purposes without permission.

 

We may decline or cancel an order where we reasonably believe uploaded content is unlawful or infringes third-party rights.

 

 

5. IMAGE QUALITY AND RESOLUTION

 

Customers are responsible for the quality and suitability of files submitted for printing.

 

Our website may provide image-resolution, quality or recommended-size indicators. These tools are intended to assist customers but cannot guarantee a particular printing result in every circumstance.

 

Print quality may depend on factors including original resolution, compression, focus, sharpness, exposure, editing, source-file quality and selected print size.

 

Enlarging a low-resolution image may produce pixelation, softness or reduced detail.

 

Where the website identifies a potential quality limitation and the customer chooses to proceed, a result attributable to the original supplied file is not necessarily a production defect.

 

This does not affect rights under the Australian Consumer Law.

 

 

6. PRODUCT PREVIEWS

 

Digital previews and mock-ups on our website are intended to help customers visualise customised products.

 

They are a visual guide rather than a guarantee of exact screen-to-product appearance.

 

Differences may arise because of monitor settings, brightness, colour calibration, RGB screen display, physical printing, natural framing materials and reasonable manufacturing tolerances.

 

We take reasonable care to represent products accurately, but exact colour matching between a screen and a physical printed or framed product cannot be guaranteed.

 

 

7. ORDERS

 

An order is submitted when checkout is completed and payment is successfully authorised or accepted.

 

You should receive an order confirmation using the contact details supplied at checkout.

 

Please review the confirmation promptly and contact us as soon as possible if you identify an error.

 

We may decline or cancel an order where reasonably necessary, including where:

 

- payment cannot be processed;

- a required material or option becomes unavailable;

- there is an obvious pricing or website error;

- the submitted content cannot reasonably or lawfully be reproduced; or

- we reasonably suspect fraud or unlawful activity.

 

If we cancel an order after receiving payment and cannot supply the product, we will provide an appropriate refund.

 

 

8. PRICING AND PAYMENT

 

Prices displayed on our Australian website are in Australian Dollars (AUD) unless otherwise stated.

 

Available payment methods are displayed at checkout and may be provided through Wix and third-party payment providers.

 

Prices and available options may change from time to time.

 

The price applicable to an order is the price displayed and accepted at checkout, subject to applicable law and correction of obvious errors.

 

Applicable delivery charges will be displayed before the order is submitted.

 

 

9. PRODUCTION TIME

 

Our standard production timeframe is approximately 7 business days unless otherwise stated.

 

Business days generally exclude weekends and Victorian public holidays.

 

Production begins after the order and payment have been successfully received and we have the information and files required to produce the order.

 

Production timeframes are estimates. If a significant delay occurs, we will take reasonable steps to communicate with you.

 

 

10. SHIPPING AND DELIVERY

 

We currently ship to eligible addresses within Australia.

 

Delivery after dispatch is generally estimated at approximately 3 business days, depending on destination and carrier.

 

The typical estimated total timeframe is therefore approximately 10 business days, consisting of production plus shipping.

 

These are estimates and not guaranteed delivery dates unless expressly stated otherwise.

 

Tracking information will be provided where available after dispatch.

11. CHANGE OF MIND AND CANCELLATIONS

 

Because Timefold products are custom-made according to individual specifications, we do not generally offer returns, exchanges or refunds simply because a customer changes their mind, selects the wrong option or no longer wants the product.

 

If production has not commenced, you may contact hello@timefold.com.au to ask whether an order can be changed or cancelled. We cannot guarantee that a change or cancellation will be possible.

 

This policy does not limit rights or remedies under the Australian Consumer Law.

 

 

12. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

 

If an order arrives damaged, defective or materially different from what was ordered, please contact hello@timefold.com.au as soon as reasonably possible.

 

We may ask for the order number, a description of the issue and photographs of the product and packaging so that we can assess the problem.

 

Where applicable, we will provide a remedy in accordance with the Australian Consumer Law.

 

For visible shipping damage, we encourage customers to contact us within 48 hours where possible so that the matter can be investigated promptly. This requested timeframe does not limit any rights or remedies under the Australian Consumer Law.

 

 

13. AUSTRALIAN CONSUMER LAW

 

Our goods and services come with consumer guarantees that cannot be excluded where the Australian Consumer Law applies.

 

For a major problem with a product, a consumer may be entitled to choose between a refund and replacement and may also have other rights under the ACL.

 

For a problem that is not major, Timefold may be entitled to provide an appropriate remedy within a reasonable time.

 

Nothing in these Terms is intended to exclude, restrict or modify a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

 

 

14. INTELLECTUAL PROPERTY

 

Unless otherwise stated, Timefold branding, logos, website design, graphics, photographs, illustrations, text and other Timefold-created website content are owned by or licensed to Timefold and protected by applicable intellectual property laws.

 

You may not reproduce, distribute, modify, publish or commercially use our content without permission except where permitted by law.

 

Customer-uploaded images and artwork remain the property of their respective owners.

 

 

15. THIRD-PARTY SERVICES

 

Our website may use third-party services for website hosting, e-commerce, payments, shipping, analytics and communications.

 

Use of certain third-party services may also be subject to the provider’s terms and privacy practices.

 

Nothing in this section limits any responsibility Timefold has to customers under applicable Australian law.

 

 

16. WEBSITE AVAILABILITY AND ERRORS

 

We aim to keep our website accurate and available but cannot guarantee uninterrupted or error-free access.

 

We may correct errors relating to product descriptions, availability, pricing or other website information where reasonably necessary.

 

Nothing in this section permits Timefold to avoid obligations under the Australian Consumer Law.

 

 

17. LIMITATION OF LIABILITY

 

To the maximum extent permitted by law, Timefold excludes liability for indirect or consequential loss where such liability may lawfully be excluded.

 

Nothing in these Terms excludes, restricts or modifies liability, consumer guarantees or other rights that cannot lawfully be excluded, restricted or modified.

 

 

18. PRIVACY

 

Personal information and customer-uploaded files are handled as described in our Privacy Policy.

 

 

19. GOVERNING LAW

 

These Terms are governed by the laws applicable in Victoria, Australia.

 

You and Timefold submit to the jurisdiction of courts and tribunals having jurisdiction in Victoria, subject to rights available under applicable consumer legislation.

 

 

20. CHANGES TO THESE TERMS

 

We may update these Terms to reflect changes to our business, website, services or legal requirements.

 

The current version will be published with its last-updated date.

 

Updated Terms apply from publication and will not retrospectively alter terms applicable to orders already accepted, except where required by law.
